STUDENT AGREEMENT
This Student Agreement ("Agreement") is entered into by and between Brainbox Edu (Pvt) Ltd, Pioneer Education (Pvt) Ltd, and Nextnewest (Pvt) Ltd (collectively referred to as the "Institution") and the Student whose details are provided through the online application form on the platforms (brainbox.lk, pioneereducations.com) (hereinafter referred to as the "Student").

1. Parties Involved

  • Institution: Brainbox Edu (Pvt) Ltd, Pioneer Education (Pvt) Ltd, and Nextnewest (Pvt) Ltd.
  • Student: Name and details of the student provided in the online application form (brainbox.lk, pioneereducations.com).

2. Student Responsibilities

  • Academic Integrity: The Student agrees to uphold the highest standards of academic integrity and honesty. Any form of cheating, plagiarism, or academic dishonesty will result in disciplinary action, which may include suspension, expulsion, or legal consequences.
  • Course Participation: The Student is expected to actively participate in all classes, assignments, and assessments. Any unauthorized absences may affect grades and academic progress.
  • Communication: The Student must regularly check official communication channels, including email and the learning management system, for important updates and information.

3. Confidentiality

  • Confidential Information: The Student agrees to keep confidential all information related to the Institution’s education system, including but not limited to course materials, assessments, and proprietary content.
  • Data Privacy: The Student’s personal details and academic records are confidential. The Institution will handle all data in compliance with relevant data protection laws, including the Data Protection Act and GDPR.
  • Non-Disclosure: The Student shall not disclose any information related to the Institution’s education system, prohibited words, images, or text to any unauthorized parties. Violations of this clause will result in legal action, including fines and penalties.

4. Rights and Ownership

  • Intellectual Property: All course materials, including but not limited to documents, videos, audio clips, and other content created or provided by the Institution, remain the sole property of the Institution. The Student acknowledges that they do not hold any ownership rights over these materials.
  • Use of Student Data: The Student agrees that Brainbox Edu (Pvt) Ltd, Pioneer Education (Pvt) Ltd, and Nextnewest (Pvt) Ltd hold full rights to use student information and data for academic, administrative, and promotional activities. This includes the right to use data for analysis, any marketing, and other business activities at the Institution's discretion.

5. Legal Consequences

  • Breach of Agreement: Any breach of this agreement will lead to legal action. The Institution reserves the right to pursue compensation, penalties, or any other legal remedies for breaches of confidentiality, misuse of materials, or other violations of this agreement.
  • Penalty Clause: The Student agrees that any unauthorized use or distribution of the Institution’s materials will result in penalties, including but not limited to fines, legal action, and potential expulsion from the program.

6. Compliance

  • Policies and Procedures: The Student agrees to adhere to all institutional policies and procedures, including those related to academic integrity, online conduct, and student engagement.
  • Legal Compliance: The Student must comply with all applicable local, national, and international laws. Non-compliance may result in disciplinary action, including termination of enrollment and legal proceedings.

7. Termination

  • Termination Clauses: The Institution reserves the right to terminate the agreement if the Student breaches any terms outlined or engages in misconduct. Termination may also occur if the Student fails to meet the academic requirements or standards set by the Institution.
  • Notice Period: Either party may terminate this agreement by providing 30 days' written notice, subject to the Institution's approval.

8. Dispute Resolution

  • Mediation/Arbitration: In the event of any dispute arising from this agreement, the parties will first attempt to resolve the matter through good-faith negotiations. If the dispute cannot be resolved, it shall be referred to mediation. If mediation fails, binding arbitration will follow, with costs shared equally by both parties.
  • Governing Law: This agreement shall be governed by the laws of Sri Lanka. Any legal action arising from this agreement shall be brought exclusively in the courts of Sri Lanka.

9. Miscellaneous

  • Amendments: Any amendments or modifications to this agreement must be made in writing and signed by both parties.
  • Entire Agreement: This agreement constitutes the entire understanding between the parties and supersedes all prior discussions and agreements.

Student: By registering and enrolling, the Student acknowledges acceptance of the terms outlined in this agreement.
